Terms and Conditions of Service

Please read these Terms (“Terms”, “Terms of Use”) carefully before using the https://mindexpedition.com/ website (the “Service”) operated by Mind Expedition (Pty) Ltd (MindX) (“us”, “we”, or “our”).

1. ACCEPTANCE OF TERMS

By accessing, downloading, or using the MindX platform, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use our services. MindX is an edutainment platform operated by Mind Expedition (Pty) Ltd (Legal Entity Name), registered in South Africa.

2. NATURE OF THE SERVICE: SKILL-BASED COMPETITIONS

2.1. No Gambling or Betting.

You acknowledge and agree that MindX is strictly a skill-based edutainment platform. Winners are determined solely by knowledge, speed, and accuracy.

2.2. Deterministic Outcomes.

MindX does not use Random Number Generators (RNG) to determine the outcome of challenges, nor do we allow betting on external uncertain events.

2.3. Skill Predominance.

Outcomes are based on your input and performance against calibrated difficulty levels or other players. Chance does not determine the material outcome of any contest.

3. ELIGIBILITY

3.1. Age Requirement.

To participate in any competition involving cash entry fees or cash prizes, you must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher).

3.2. Location.

You may only access the Service from jurisdictions where skill-based cash competitions are legal. MindX reserves the right to verify your location via geofencing technology.

3.3. Employees and Affiliates.

Employees of MindX and immediate family members are prohibited from participating in cash-prize competitions.

4. ACCOUNT REGISTRATION AND SECURITY

4.1. Account Creation.

You must provide accurate, current, and complete information during the registration process.

4.2. Identity Verification (KYC).

To comply with Anti-Money Laundering (AML) regulations, we require identity verification before you can withdraw funds or exceed certain transaction thresholds. You agree to provide valid identification documents upon request.

4.3. One Account Policy.

You are permitted to maintain only one account. Creating multiple accounts to bypass limits or manipulate the system is a violation of these Terms and will result in immediate suspension.

5. PLAY MODES AND MECHANICS

5.1. Solo Challenges.

Mechanics: You compete against a calibrated difficulty curve.

Scoring: Outcomes are calculated based on correctness and time.

Prizes: Payouts are deterministic based on the selected difficulty tier.

5.2. Social Challenges (Private Groups).

Mechanics: You compete against invited participants in a synchronized session.

Prize Pool: The total entry fees constitute the prize pool. MindX deducts a Platform Fee (approximately 5%) from the total pool before distribution to winners.

5.3. Community and Sponsored Events.

Mechanics: Time-boxed tournaments open to the public or specific institutions.

Fundraising: In events designated as "Fundraisers" or "Community Drives," a specified portion of the proceeds (as defined in the specific event rules) will be ring-fenced and paid directly to the designated beneficiary institution.

6. FINANCIAL TERMS

6.1. Wallet Top-Up.

Funds deposited into your MindX wallet are held in your user balance. These funds do not accrue interest and are not insured by banking deposit insurance schemes unless explicitly stated.

6.2. Entry Fees.

Entry fees are debited from your wallet immediately upon joining a challenge.

6.3. Settlements.

BUX Winnings are credited to your in-app wallet immediately upon the conclusion of a challenge and finalisation of the leaderboard.

6.4. Withdrawals.

You may request a withdrawal of your "Winnings" balance at any time, subject to:

Completion of KYC verification.

Minimum withdrawal thresholds.

Processing times of our payment partners.

6.5. Refunds.

Refunds are only issued in the event of a technical error or platform outage that prevents the completion of a game instance. We do not offer refunds for losses incurred due to lack of skill or poor internet connection on your device.

7. FAIR PLAY AND INTEGRITY

7.1. Zero Tolerance for Cheating.

MindX utilises device fingerprinting, anomaly scoring, and audit logs to detect abuse. Prohibited activities include:

Using bots or AI assistance.

Collusion with other players in Social modes.

Account sharing.

7.2. Reversible Actions.

If you are found to be in violation of our Fair Play Policy, MindX reserves the right to void your scores, forfeit your winnings, suspend your account, and ban your device.

7.3. Disputes.

All game outcomes are final. In the event of a dispute, MindX’s server logs and audit trails will be the final authority in determining the outcome.

8. AMBASSADOR AND CREATOR PROGRAM (A22)

If you participate as a Creator or Ambassador:

8.1. You are entitled to revenue share on attributed traffic strictly according to the specific Ambassador Agreement.

8.2. You agree to disclose your relationship with MindX in all promotional material.

8.3. MindX reserves the right to withhold payments if traffic is deemed fraudulent or incentivised in violation of our policies.

9. RESPONSIBLE PLAY

Although MindX is not a gambling platform, we are committed to player safety. We offer tools including:

Spend Limits: Configurable caps on daily/weekly entry fees.

Cool-Off Periods: Temporary account suspension options.

Self-Exclusion: Permanent account blocking upon request.

10. INTELLECTUAL PROPERTY

10.1. Content Ownership.

All questions, quizzes, graphics, and software code are the property of MindX or its licensors.

10.2. User License.

You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal entertainment.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, MindX shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the service. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in entry fees in the six (6) months preceding the claim.

12. PRIVACY

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share your personal information in compliance with [Relevant Data Laws, e.g., GDPR/POPIA/CCPA].

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1. These Terms shall be governed by the laws of South Africa.

13.2. Any disputes arising from these Terms shall be resolved through binding arbitration in South Africa, except where local consumer protection laws strictly prohibit such clauses.
